New from Southern NH and could use some help.

Hey everyone my name is Josh, I’m from Allenstown NH. I got my 08 wrx back in april. The pic is from when I first bought it, I’ll have to check around and see if I can find any others. Mostly stock at this point.

Here’s my problem… I was headed over to Candia to pick up my buddy for the fall Cruise this past Sunday. I was using my ‘trusty’ GPS to find it since I’ve never been the area before. His house is on a dirt road, alright no big deal. Unfortunately the GPS sends me in the opposite direction, nothing seems out of place, got a few houses and stuff, thing tells me to keep going so I do, all of the sudden the road starts getting a little rough, not great but still doable, next thing I know it’s pretty much a class VI road; rocks logs, you name it. I managed to get out of it with what looked like just a popped side skirt, unfortunately today I was looking at it and it has a nice big crack on the front bumper, also haven’t had a chance to look underneath, hoping nothing bad under there. What pissed me of was that there was no signs, gates etc. warning that this road was unmaintained. Now as if that wasn’t #!#!#!#!ty enough ended up getting into a luckily, minor fender bender with Matty S2K up at the meeting point in Maine. Basically my question is, is there any action I can take against the town to recoup the cost from the damages to my car caused by the road, I’m already gonna have to pay a nice deductible on my rear bumper from the collision plus the increase to my rates, I’d rather not have to shell a ton more for the other damage or have to put in another claim back to back with the other one. Any advice on this would be much appreciated.

A lot of states have a "use at your own risk" policy for ALL roads. You best bet for that would be to consult with a lawyer I would say.

Good luck and welcome to the forum!

No. It does not have to be marked, and it was dirt to start with. You drove down it on your own free will. Sorry to say but you're out of luck all around.

If it was a paved public through way and say, a manhole cover was missing and you drove into it, then yes, you can take action.

Josh you have a very standard color in the wrx, idk maybe theres a bumper for sal on CL and you can fix the side skirts your self if theres no damage under the car. And not file a claim...

Idk just thinking out loud. I know I managed to find a stock bumper for $50 and after painting and what not it was only $200 to do my front swap.

My friend in highschool drove too fast over a pothole, lost control, and ended up in a ditch. His body kit was completely destroyed and so were his walmart rims. Anyway, he tried to sue the town and instead he got a warning for driving too fast for the conditions on the road. I'm sorry but I don't think you can do anything about this incident. The road was clearly rough to begin with so that's the argument the lawyers will use against you if you somehow get this case in court. If you have any speeding tickets in the past, it will be even harder for you to win due to the fact that the town will say you were flying down that road. I think you're out of luck on this one.

I looked around on CL and Ebay nothing really atm, I will definitely keep a lookout though.

No speeding tickets surprisingly but I'm sure they would find some way to screw me. Definitely not worth the legal fees.
